This Privacy Policy explains how OPSAVO LLC ("OpsAVO," "we," "us," or "our") collects, uses, discloses, stores, and otherwise processes personal information in connection with our websites, applications, platform, communications, and related services.
This Privacy Policy applies to information we process as a business, including when you visit our websites, communicate with us, request a demo, create an account, use the Services, or interact with us as a customer, prospect, administrator, user, contractor, or end user.
1. Scope and Roles
In many cases, OpsAVO provides services to business customers that control the data submitted to the Services. In those cases, OpsAVO may act as a service provider or processor on behalf of our customer, and that customer is responsible for its own notices, instructions, legal basis, and data subject rights handling.
If you are an end customer of one of our business customers and want to exercise rights regarding data that customer controls, you should contact that business directly first.
2. Information We Collect
We may collect the following categories of information.
2.1 Information You Provide Directly
This may include:
- name, business name, username, title, mailing address, email address, phone number, and account credentials;
- billing details, subscription details, and transaction-related information;
- communications with us, support requests, survey responses, and feedback;
- information submitted through forms, uploads, onboarding, integrations, or profile settings;
- customer, lead, appointment, staff, and business information you choose to input into the Services; and
- any other information you choose to provide.
2.2 Communications and Interaction Data
Depending on how you use the Services, we may process:
- call metadata, call recordings, voicemail, transcripts, summaries, and dispositions;
- SMS, MMS, email, chat, web form, inbox, ticket, and conversation data;
- AI prompts, instructions, outputs, routing rules, workflow actions, and automation logs; and
- scheduling, booking, calendar, appointment, and reminder data.
2.3 Device, Log, and Usage Data
We may automatically collect:
- IP address, browser type, device type, operating system, identifiers, referral URLs, language settings, and approximate location derived from IP;
- pages viewed, features used, clicks, session data, timestamps, diagnostics, crash data, and performance data; and
- cookie, analytics, and similar tracking information.
2.4 Payment and Transaction Data
When payments are processed through or in connection with the Services, we may receive transaction metadata, billing status, payout details, dispute information, tax-related information, and account status information. Full payment card details are generally processed by our payment processors, not stored by OpsAVO except as permitted and necessary.
2.5 Information from Third Parties
We may receive information from third-party services and integrations, including communications providers, payment processors, identity providers, calendar providers, analytics providers, CRM systems, websites, and your connected applications.
3. How We Use Information
We may use personal information to:
- provide, operate, maintain, support, and improve the Services;
- create and manage accounts, organizations, users, and permissions;
- process transactions, subscriptions, invoices, disputes, and collections;
- provision phone numbers, communications services, registrations, sender identities, and related service features;
- route calls, messages, appointments, and workflows;
- generate AI outputs, summaries, automations, classifications, recommendations, and logs;
- communicate with you about the Services, updates, support, billing, account activity, and security;
- personalize and improve user experience;
- monitor performance, troubleshoot issues, debug, and conduct analytics;
- protect against fraud, abuse, spam, security threats, and unauthorized access;
- enforce contracts, policies, and legal rights;
- comply with law, legal process, regulatory requirements, carrier requirements, and contractual obligations; and
- develop new features and business operations.
We may aggregate and de-identify information and use it for lawful business purposes. De-identified information is not treated as personal information under this Privacy Policy.
4. Legal Bases for Processing
Where applicable, we process personal information based on one or more of the following: performance of a contract, legitimate interests, consent, compliance with legal obligations, and other lawful bases recognized under applicable law.
5. How We Disclose Information
We may disclose personal information to:
- service providers, contractors, subprocessors, and vendors that help us operate the Services;
- communications providers, telecom carriers, AI providers, payment processors, hosting providers, analytics providers, security providers, support providers, and integration partners;
- your organization, administrators, users, staff, contractors, and authorized representatives;
- third parties at your direction or through your integrations and configurations;
- professional advisors, auditors, insurers, financing sources, and potential acquirers or investors in connection with corporate transactions;

5.1 SMS Consent and Mobile Information
If you provide your mobile phone number and consent to receive SMS messages from OpsAVO, we will not share, sell, rent, or disclose that mobile number or your SMS opt-in consent to third parties or affiliates for their own marketing or promotional purposes. We may use service providers strictly as necessary to deliver and support our messaging services; those providers may not use your mobile number or SMS consent information for their own marketing or promotional purposes.
When you opt in to receive SMS messages from OpsAVO, we use your phone number and related consent information only to send the transactional messages you requested, such as messages about account setup, onboarding, appointments, billing, support updates, alerts, and service notifications.
6. Communications Data and Recordings
If you use calling, messaging, chat, or related features, we may process communications content, metadata, recordings, transcripts, and summaries to provide the Services, perform quality assurance, enforce policies, support customers, improve features, and protect the Services.
You are responsible for providing all required notices and obtaining all necessary consents for calls, recordings, texts, messages, voicemails, AI interactions, and other communications that occur using the Services.
7. AI and Automated Processing
We may use personal information and Customer Content to provide AI-powered features, including classification, summarization, suggestions, extraction, workflow automation, and voice or chat functionality.
Because AI features may produce unexpected outputs, you should not rely solely on those outputs for important decisions without appropriate review.
Unless otherwise stated in a separate agreement, we may use service data, usage data, diagnostics, and de-identified information to improve the Services. We do not use your Customer Content to train third-party general-purpose foundation models for their own independent use unless disclosed by us or authorized by you.
9. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain records, enforce agreements, resolve disputes, comply with legal obligations, and protect the Services.
Retention periods may vary depending on the type of information, your account status, legal requirements, contractual obligations, operational needs, and whether deletion, anonymization, or archival is appropriate.
10. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission, storage, or security is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the security of your devices, credentials, integrations, and operational environment.
11. International Transfers
We may process and store personal information in the United States and other jurisdictions where we or our service providers operate. Those jurisdictions may have data protection laws that differ from the laws of your jurisdiction.
By using the Services, you understand that your information may be transferred to and processed in those jurisdictions, subject to applicable law.
12. Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal information, such as the right to request access, correction, deletion, portability, restriction, objection, or information about our processing practices.

If we process your information on behalf of a business customer, we may direct your request to that customer or ask you to contact them directly.
We will not unlawfully discriminate against you for exercising applicable privacy rights.
13. Marketing Communications
We may send you service-related communications and, where permitted, marketing communications. You can opt out of marketing emails by following the unsubscribe instructions in those emails. You may still receive transactional or service-related messages.
For SMS and similar messaging, you can follow the opt-out instructions provided in the message, such as replying STOP where supported.
14. Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 in our consumer-facing interfaces. If you believe a child under 13 has provided personal information to us, contact us and we will take appropriate steps.
15. Sensitive and Regulated Data
Unless OpsAVO expressly agrees in writing otherwise, please do not submit highly sensitive information or regulated data to the Services unless necessary for an approved use case and covered by appropriate contractual and operational safeguards.
If you operate in healthcare, wellness, medspa, dental, finance, employment, or similar regulated fields, you are responsible for determining whether additional notices, consents, agreements, or restrictions apply to your use of the Services.
16. Third-Party Websites and Services
The Services may contain links to third-party websites or connect with third-party services. We are not responsible for the privacy or security practices of third parties.
17. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated version and update the effective date. If changes are material, we may provide additional notice where required or appropriate.
