Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs use of the Services by Customer and all of Customer's users, administrators, staff, agents, contractors, and anyone acting through Customer's account.
Customer may not use the Services, and may not allow others to use the Services, to do any of the following:
1. Illegal, Harmful, or Deceptive Use
- violate any law, regulation, court order, carrier rule, platform policy, or third-party right;
- engage in fraud, deception, phishing, impersonation, harassment, abuse, stalking, threats, or unlawful surveillance;
- send spam or unlawful communications;
- misrepresent the source, sender, or purpose of a communication;
- use false, misleading, or fabricated caller ID, sender identity, or branding; or
- interfere with the integrity, operation, or security of the Services.
2. Restricted Content and Verticals
Customer may not use the Services for:
- political campaigning, fundraising, advocacy, or political persuasion;
- adult content, sexual services, or sexually explicit content;
- gambling, wagering, sweepstakes, or similar gaming activity unless expressly approved by OpsAVO in writing;
- cryptocurrency promotion, token sales, investment solicitation, or related speculation;
- short-term lending, payday lending, or similar high-risk financial solicitations;
- lead resale, purchased leads, or contact brokering;
- unlawful drug, controlled substance, or prohibited product promotion; or
- any use case prohibited by carriers, telecom providers, payment processors, or other third-party providers.
Debt collection use is permitted only if Customer independently ensures full legal compliance and carrier compliance in every applicable jurisdiction.
3. AI, Advice, and Accuracy
Customer may not represent AI outputs, summaries, recommendations, or generated content from the Services as guaranteed accurate, factual, complete, or suitable for professional reliance.
Customer may not use the Services to provide or hold out AI-generated content as medical advice, legal advice, financial advice, mental health advice, emergency guidance, or other professional advice that could reasonably cause harm if inaccurate, unless lawfully supervised and independently verified by qualified humans.
4. Emergency and High-Risk Use
Customer may not use the Services for 911, emergency dispatch, crisis intervention, life-critical functions, or high-risk activities where failure, delay, or inaccuracy could result in death, personal injury, or major property damage.
5. Messaging and Outreach Restrictions
Customer may not:
- send messages, emails, or calls without required consent, notice, or lawful basis;
- use purchased lists, scraped contacts, rented lists, shared opt-ins, or unlawfully obtained contact data;
- conduct unlawful cold outreach, spam, robocalling, or prohibited telemarketing;
- fail to honor opt-outs, do-not-call requests, or revocations of consent;
- combine consent for messaging with unrelated mandatory service acceptance where prohibited;
- hide required disclosures or consent language inside unrelated agreements; or
- use one business's consent to send messages for another business, brand, or campaign.
Customer is solely responsible for determining whether marketing, transactional, conversational, or collection messages are lawful in each jurisdiction where Customer operates or sends messages.
6. AI Agent Disclosure and Human Impersonation
Customer may not use the Services to deceptively impersonate a human being. Where applicable by law, regulation, carrier rule, or platform policy, Customer must clearly disclose when a person is interacting with an automated system, AI agent, synthetic voice, or bot.
7. Data Rights and Children
Customer may not upload, process, transmit, or use data that Customer does not have the right to use. Customer may not target children under 13 or knowingly use the Services to collect personal information directly from children under 13 in violation of applicable law.
8. Platform Abuse
Customer may not:
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or model behavior except where non-waivable law permits it;
- use the Services to train or improve competing AI models, competing software, or benchmarking datasets;
- publish public benchmarks, performance comparisons, or security test results about the Services without OpsAVO's prior written consent;
- attempt to bypass usage limits, fees, controls, security features, or access restrictions; or
- introduce malware, harmful code, or abusive automation into the Services.
9. Enforcement
OpsAVO may investigate suspected violations and may suspend, restrict, disable, or terminate access immediately, with or without notice, for actual or suspected fraud, spam, carrier risk, legal risk, policy violations, security concerns, nonpayment, or any activity that could harm OpsAVO, its providers, or others.
OpsAVO may remove content, block communications, preserve records, cooperate with providers and authorities, and take any other action it reasonably believes is necessary to protect the Services or comply with law.
